Apple remains the world’s dominant digital music retailer, but it’s a distinction that might be of decreasing significance as the digital market transforms from a model based on a la carte downloads to one of streaming access. Indeed, Apple’s late-year acquisition of streaming music provider Lala points to the company’s own expected shift in that direction.

MySpace Records, the indie record label that’s a joint venture between the social network and Interscope Records, is going through some changes. Not to be confused with MySpace’s popular MySpace Music free streaming portal, MySpace Records is a small record label designed to help promising new artists get early exposure. LA-based radio station KROQ has reported that MySpace Records may have been disbanded.

*** – TECH GROUP TO LAUNCH DIGITAL MUSIC FILE SUCCESSOR

A leading technology company is set to launch a new digital music file format which will embed additional content for fans
including lyrics, news updates and images in what could be a successor to the ubiquitous MP3 file. The music industry has been
hammered by piracy in the last decade and is looking to develop new offerings to entice consumers to buy their music from
legitimate sites, instead of taking it from illegal outlets.

The new proposal, which is called MusicDNA and has the backing of the original MP3 digital music file inventor, and would allow fans to download an MP3 file on to their computer, which would carry with it additional content.

The lobbying group for the top four recording companies wants to make sure that when regulations on Net neutrality are adopted,
they don’t impede antipiracy efforts. That’s why the Recording Industry Association of America asked the Federal Communications
Commission to “adopt flexible rules” that free Internet service providers to fight copyright theft.

*** – JUDGE CUTS $2M PENALTY IN MINNESOTA SONG-SHARING CASE

A federal judge has drastically reduced a nearly $2 million verdict against a Minnesota woman found guilty last year of sharing 24 songs over the Internet, calling the jury’s penalty “monstrous and shocking.” “The need for deterrence cannot justify a $2 million verdict for stealing and illegally distributing 24 songs for the sole purpose of obtaining free music,” Davis wrote.

He gave the Recording Industry Association of America seven days to either accept the smaller penalty or to ask for another trial
to set new damages.

*** – MTV GAMES SEEKS INDIE BUZZ FOR “ROCK BAND”

MTV Games is hoping to goose sales of its flagging “Rock Band” series with a new service that lets average users upload and sell
videogame versions of their own music. The service, known as the Rock Band Network Store, may offer a few minutes of fame to
garage bands by allowing millions of game players to access their music. But given the technical know-how needed to format a song
for the game – which may require users to hire a pricey third- party developer – the service could wind up serving mostly as a
promotional platform for established acts with deeper pockets.

To the tech-minded, it’s innovation. To traditional musicians, it might just be blasphemy. The Misa Digital Guitar has taken the
strings out and put a touch screen in their place. According to the manufacturer’s site, the Misa Digital Guitar is not a replacement for the “analog” string instrument, but rather is meant to morph sounds “in an infinite number of ways.”
